FAQs

Is CBD oil legal in Arizona?

Yes, CBD oil was first legalized in Arizona in 2010 and Senate Bill 1098 in 2018 provided guidelines for the production of “industrial hemp” to further clarify the use of CBD oil. It is relatively easy to purchase and is legal as long as it is derived from the hemp plant and not the marijuana plant.

 

However, SB 1098 and other Arizona state laws around CBD are somewhat ambiguous. Generally they allow for the state to regulate the growth, harvest, research, and sale of industrial hemp with less than 0.3% THC by dry weight. While there is no specific mention of CBD oil in the Arizona law, most people have interpreted the language of SB 1098 and the federal 2018 Farm Bill that reclassified hemp as an agricultural product instead of a Schedule I controlled substance to include CBD oil.

How is CBD oil different from marijuana?

Both CBD oil and marijuana come from the cannabis plant, but CBD does not contain the psychoactive component tetrahydrocannabinol (THC), which is what produces a “high” in marijuana. CBD stands for cannabinoid, which is the second-most abundant substance in cannabis plants after THC. You can get CBD oil from either a marijuana plant or a hemp plant, but only products derived from hemp plants are legal in Arizona.

 

Research shows that CBD oil can provide several therapeutic benefits, including anti-anxiety, anti-inflammatory, and anti-seizure properties and shows no indication of abuse or dependence.

Can CBD oil be illegal in Arizona?

Yes, if it contains more than 0.3% THC. It’s important to purchase CBD oil from a reputable retail establishment to ensure compliance with state and federal regulations.

 

Anyone who would like to grow, process, harvest, or transport hemp products must have a license issued by the Arizona Department of Agriculture. Growers have to submit reports to the state and submit to inspection prior to harvesting hemp plants to ensure they do not exceed the legal limit of 0.3% THC.

What are the Arizona CBD oil possession limits?

There is no legal limit to the amount of CBD oil you can possess as long as it meets the state requirements of having less than 0.3% THC.

 

Arizona does not allow the use of recreational marijuana, so anyone in possession of cannabis-derived CBD with THC will be subject to felony charges according to state law. The maximum sentence and fines are based on how much you are found to be in possession of at the time of your arrest, ranging from 4 months to 3.75 years and fines of up to $150,000.

 

Patients registered with the Arizona medical marijuana program you can get THC and CBD products from medical dispensaries, and can be in possession of up to 2.5 ounces of cannabis in any 14-day period.

How do I know if the CBD oil I’m purchasing is legal and good quality?

Since CBD oil is classified by the FDA as a supplement, it is not as heavily regulated as prescription medication, and some companies may not provide adequate or completely accurate information on their labels. It’s important to purchase from a reputable CBD producer and seller so you know you’re getting what you expect in your CBD products. Look for this important information on the label:
