Is CBD oil legal in Utah?
Yes. On December 3, 2018 the Utah legislature passed House Bill 3001 (the Utah Medical Cannabis Act) that legalized the sale, possession, and use of CBD oil that contains 0.3% THC or less. The same act legalized medical marijuana for use under the direction of a medical provider for someone with specific medical conditions. Recreational (non-medical) use of marijuana is still illegal in Utah.
The federal government also passed the 2018 Farm Bill, reclassifying hemp with less than 0.3% THC as an “agricultural commodity” instead of a Schedule I drug, which makes CBD derived from cannabis legal as long as it complies with federal and state regulations during cultivation. Not all hemp is legal under this act, and it’s important to only purchase from entities that follow all state and federal guidelines.
What are the Utah CBD possession limits?
Currently there are no limits to the possession of hemp-derived CBD oil in Utah. You can purchase it from any retail location licensed with the Utah Department of Agriculture and Food. Generally it’s available at places like retail pharmacies, health food stores, and vape or smoke shops.
